Promoter:

Promotion Overview:

The Promotion will consist of two (2) award categories:

  • 2019 L'Oréal Professionnel Colour Trophy Award (3 winners); and
  • 2019 L'Oréal Professionnel Rising Star Award.

The Promotion will consist of three (3) Rounds of judging:

  • Round one (1) Photographic Entry.
  • Round two (2) Live Semi Finals.
  • Round three (3) Grand Finale.

All successful candidates into the Grand Finale will also be automatically eligible to win the 2019 L'Oréal Professionnel Readers' Choice Award with a luxury fashion consumer magazine.

Entry Period:

Start date: Friday 01/06/18
End date: 5pm AEST on Friday 31/08/18

Eligibility Requirements

Eligible entrants:

a. Entry is only open to Australian residents who are 18 years and over on End Date and who are a qualified hairdresser or apprentice hairdresser employed full time or a student enrolled full time at a private hairdressing college in Australia.

b. All entrants must be available for both the Semi Finals (to be held in regional locations) and the Grand Finale (to be held in Melbourne) on the nominated dates outlined in this document.

c. All winning entrants must be employed with their salon until 31/12/19

d. The entrants' salon must be trading at the time of entry. If the salon is trading with L'Oréal Australia, it must be fully compliant with L'Oréal's conditions of sale and credit terms at all stages of the Promotion.

e. Entrants must obtain the consent of the salon owner(s) where they are employed to enter into this Promotion.

f. The entrants' salon, or any members of that salon, cannot be part of the L'Oréal Colour Trophy judging panel.

If an entrant is a student rather than an employee of a salon - the above requirements referencing a salon do not apply. But they must have consent from their private hairdressing college to enter into this Promotion.

Eligibility for the 2019L'OréalProfessionnelColour Trophy Award (Can enter as INDIVIDUAL or TEAM):

a. Entry may be as a "Team" or "Individual" on behalf of your salon or college.

b. An individual entry consists of one (1) person being the cutter, stylist & colourist.

c. A Team entry can have a maximum of two (2) Individuals from the same salon consisting of one (1) Colourist and one (1) Cutter/Stylist.

d. All members of the Team must meet the eligible entrants criteria above.

e. A Team entry is on behalf of one salon.

f. An Individual entry is on behalf of one salon.

g. The team members and the model should remain the same throughout the Promotion, unless otherwise permitted by the Promoter. However, in circumstances of unavailability after Round 1, the same model must be used for Round 2 (Semi Finals) and Round 3 (Grand Final). If the same model is not used for Round 2 and Round 3, the entrant will at the Promoter's discretion be disqualified. The Promoter will deviate from this rule based on individual circumstances, to be determined at L'Oréal Australia's sole discretion. The original photograph with the original model from Round 1 may, at the Promoter's discretion, only be used for any future coverage that results from this Promotion or events from this Promotion.

h. Should a Team or Individual be successful after the Photographic Entry (Round 1) and advance through to the Semi Finals (Round 2) and/or the Grand Finale (Round 3) the model, clothes, make-up and hairstyle must remain the same.

i. The models used at all stages of the competition must be 18 years or over and have had an allergy alert test 48 hours before the colour application.

j. There is no limit to the amount of teams/individuals who can enter from the same salon, however the same individual/team may enter a maximum of three (3) times.

k. If more than one entry is chosen for the Semi Finals from the same Team/Individual, the highest-ranking entry will advance to the Semi Finals and the other chosen entries will be discarded.

l. The same team/individual (or any members of a team) will not be able to be chosen both for the Colour Trophy Award and L'Oréal Professionnel Rising Star Award, unless otherwise specified by the Promoter. In such circumstances, the Promoter will elect which award category they will be chosen for.

m. The Promoter may deviate from any rules outlined in this section as they see fit.

Eligibility for the 2019 L'Oréal Professionnel Rising Star Award (Can only enter as an INDIVIDUAL):

a. Individual entries permitted only.

b. An Individual entry is on behalf of your salon/college.

c. The entrant and model should remain the same throughout the Promotion, unless otherwise permitted by the Promoter. However, in circumstances of unavailability at the end of Round 1, the same model must be used for Round 2 (Semi Finals) and Round 3 (Grand Final). The Promoter will deviate from this rule based on individual circumstances, to be determined at L'Oréal Australia's sole discretion. The original photograph with the original model from Round 1 may, at the Promoter's discretion, only be used for any future coverage that results from this Promotion or events from this Promotion.

d. Should an individual be successful after the Photographic Entry (Round 1) and advance through to the Semi Finals (Round 2) and/or the Grand Finale (Round 3) the model, clothes, make-up and hairstyle must remain the same.

Entry Requirements

How to Enter:

a. Entrants must create a well-executed, inspirational and modern total look on a model.

b. Entrants must complete the online entry form at www.lorealcolourtrophy.com.au and pay the $50 entry fee before submitting their entry.

c. Entries must be completed online and must be received by the Promoter between Friday 01/06/18 and 5pm AEST on Friday 31/08/18.

d. Entries will only be accepted on the official online form. Incomplete, illegal, illegible, misdirected or late entries will not be accepted. The Promoter accepts no responsibility for lost, damaged or delayed entries.

e. Photo submission requirements:

o All entry photographs must be in colour and in portrait orientation (not landscape).

o All photos must be submitted on a plain background.

o No scans of printed photos will be accepted.

o All entry photographs must allow a minimum of 25mm between the hair and the edge of the photograph. The photograph must be received as a JPG file at A4 size (210mm wide x 297mm high) in high resolution (300 pixels/inch).

o The entry photograph must not have been used in any previous competitions.

o The entry photograph must be from the waist up on the model.

f. Products that MUST be used to create 'look':

o Entrants must only use L'Oréal Professionnel colour and styling products on the model and no other products.

o Entrants must use L'Oréal Professionnel Smart Bond in their colour work.

g. Further requirements for the 'look':

o Wefts, weaves, hair extensions or wigs are not allowed to be used.

o No up-dos are allowed.

h. The Promoter reserves the right to revise these dates and extend the period for accepting entries to the Promotion, including in the event of circumstances arising beyond its reasonable control.

i. Late entries will not be permitted.

j. The judges' decision is final and no correspondence will be entered into regarding this decision.

Entries permitted:

Multiple entries permitted per individual or team (up to a maximum of 3 per individual or team). However, each entry submitted must be different and use a different model.

Additional Significant Conditions:

  • All prizes awarded to the salon must be claimed during the salon's winning year - from Monday 25/02/19 to Tuesday 31/12/19.
  • Entries cannot be returned and are the property of the Promoter.
  • Entry to the L'Oréal Colour Trophy is AUD $50 including an AUD$5 donation to The White Ribbon Foundation.
  • The winning salon and team members must be prepared to take part in publicity accompanying or resulting from the competition. No additional compensation will be awarded for such promotional activities.
  • Any images supplied by L'Oréal to winning salons must always be credited to L'Oréal Colour Trophy when being used for any purpose whatsoever.
  • The Promoter reserves the right in its absolute discretion to add to or waive any of these terms and conditions, or to cancel the competition at any stage, including in the event of circumstances arising beyond its reasonable control.
  • Victoria, Australia, law applies and the Australian courts shall have exclusive jurisdiction over any proceedings in connection with this competition.
  • Entries cannot be returned and are the property of the Promoter, unless otherwise permitted by the Promoter.
  • Entrants grant the Promoter Limited with a transferrable, exclusive, worldwide, royalty free and perpetual license in all copyright, moral or other rights under the Copyright, Design and Patents Act 1988 to use the photos and any materials, videos and images generated during the L'Oréal Colour Trophy competition (whether they proceed to the Semi Finals and Grand Final or not) for any purpose whatsoever (including without limitation, use on L'Oréal Professionnel websites, Facebook pages and blogs, promotion of the L'Oréal Colour Trophy event, PR content print and online, editorial, advertising and advertorial content, trade press and 2018/2019 promotion print and online and educational or internal purposes, etc).

Round One

PHOTOGRAPHIC ENTRY

  • Entrants must create a well-executed, inspirational, modern colour on a model. This must be complemented by a beautiful style, finish and total look taking inspiration from upcoming trends.
  • The total look must be original, innovative and fashion forward, reflecting the new season's trends, but still wearable (commercial).
  • The photographic entries will be judged by a panel of International hairdressing industry leaders as selected by the Promoter.
  • The Promoter has the right to change the judging panel at its absolute discretion, including if any unforeseeable circumstances arise.
  • All entries are allocated to one of five (5) regions depending on the postcode of the salon. These regions are:

1. New South Wales & Australian Capital Territory

2. Victoria

3. South Australia & Tasmania

4. Western Australia

5. Northern Territory & Queensland

  • The judges will rank each photo with a score between 1 and 10 (10 being the highest ranking).
  • The judge's individual scores will be combined to provide an overall ranking for each entrant.
  • The judges' decision is final and no correspondence will be entered into regarding this decision.

Judging Criteria:

  • The photograph submitted will be judged on the following:
    • Showcase of the entrant's interpretation of the brief.
    • Showcase of a beautiful hair image on a model, ensuring the colour on the model's hair works in harmony with the cut and/or styling.
    • Colour work created on the model's hair and the overall finished cut and/or styling.
  • Points will be awarded as follows:
    • 50% Colour placement, execution, technique & colour choice;
    • 30% Finished result of hair styling / cut (if featured)
    • 20% Complete Look, Styling of photograph and Luxury Consumer Magazine potential

Number of Winners:

  • 2019 L'Oréal Professionnel Colour Trophy Award: The highest 20 ranked entries in each region will advance to Round 2, the Semi Finals.
  • 2019 L'Oréal Professionnel Rising Star Award: The highest 5 ranked entries in each region will advance to Round 2, the Semi Finals.
  • Tie-break mechanic: In the event of a tie for a top 20 or top 5 ranked entry as referenced above, the Promoter will break the tie by re-judging based on the Judging Criteria referenced in this section.

Round Two - Semi Final

LIVE RE-CREATION

  • A list of the entrants successfully through to each Semi Final will be published on www.lorealcolourtrophy.com.au from Monday 1st October 2018 in the "Finalists" tab.
  • All entrants will be notified as to whether they have qualified for the Live Semi Finals by email by 24/09/2018
  • All Semi Finalists will be brought together in each region to recreate their look in front of L'Oréal Professionnel representatives.
  • The regional Semi Final dates are confirmed as follows:
    • South Australia & Tasmania = 14th October 2018
    • Western Australia & Northern Territory = 16th October 2018
    • Queensland = 21st October 2018
    • New South Wales & Australian Capital Territory = 23rd October 2018
    • Victoria = 29th October 2018

· L'Oréal reserves the right to change the Semi Final dates, including in the event of circumstances arising beyond its reasonable control.

  • All Semi Finalists will need to complete and sign the model release form at the Live Semi Finals.
  • All Semi Finalists will be given four (4) hours to recreate their winning Photographic look (from Round 1).
  • Pre-lightening may be done prior to arrival, only if it's full head lightening. Colour must be applied for full development time on the day.
  • The Semi Finalists' completed looks will be judged by a panel of National hairdressing industry leaders as selected by the Promoter.
  • The Promoter has the right to change the judging panel at its absolute discretion, including if any unforeseeable circumstances arise. The Promoter may appoint a new judge in the circumstance that any judge is connected with a team or individual.
  • The rankings from each round do not go towards scores in subsequent rounds.
  • The judges' decision is final and no correspondence will be entered into regarding this decision.

Judging Criteria:

  • Points will be awarded as follows:
    • 70% Hair; Broken down by
      • 50%: Colour Placement execution, technique and colour choice
      • 20%: Finished result of hair styling / cut if featured
    • 20% Complete Look, Styling of photograph and Luxury Consumer Magazine potential
    • 10% how closely you have re-created your photographic entry
  • The competitors must demonstrate the following:
    • THE COLOUR:
      • The colour on the model should be technically well-executed
      • Should be a modern, fashion-forward and beautiful interpretation of upcoming trends
      • Should showcase the expertise and ability of the colourist to create a unique look.

NB: Colour choice and saturation of colour will be judged; and colour will be the overriding factor in any decision making process

    • THE HAIR:
      • Can be any length, texture or colour but has to be inspirational and show skill in the colour, style/cut and finish.
      • The hair must be in optimal condition - if the hair is in bad condition the model will not be considered as a Grand Finalist
      • The hair must suit the model's face and bone structure
      • The hair style must be modern and on-trend
    • THE CUT:
      • If featured, must show exceptional technical skill to THE FINISH:
      • On the hair must be accompanied with an appropriate amount of product (not too much), and the correct choice of product for the colour/style.
    • THE COMPLETE LOOK:
      • The clothes should enhance and complement the overall look that the colourist and hair stylist have created.
      • The clothes should be fashion-forward and on-trend, accurately representing the brief to align with a commercial magazine cover.
      • The model does not have to be professional but should be confident, self-assured, 'own' their look and walk convincingly down the catwalk

Number of Winners:

  • 2019 L'Oréal Professionnel Colour Trophy Award: The highest three (3) ranked entries in each region will advance to Round 3, the Grand Finale.
  • 2019 L'Oréal Professionnel Rising Star Award: The highest ranked entrant in each region will advance to Round 3, the Grand Finale.

Publication of Winners:

  • All Grand Finalists will be announced at the Regional Finals then displayed on the www.lorealcolourtrophy.com.au website in the "Finalists" tab from 1/11/2018

Round Three - Grand Finale

General Conditions:

  • All Grand Finalists will come together in Melbourne on Monday 25/02/19 to recreate their look in front of L'Oréal Professionnel representatives.
  • L'Oréal reserves the right to change the Grand Finale date, including in the event of circumstances arising beyond its reasonable control.
  • All Grand Finalists will need to complete and sign the model release form at their Backstage Live final.
  • All Grand Finalists will be given four (4) hours to recreate their winning Photographic look (from Round 2).
  • Pre-lightening may be done prior to arrival, only if it's full head lightening. Colour must be applied for full development time on the day.
  • The Grand Finalists' completed looks will be judged by a panel of National and International hairdressing industry leaders as selected by the Promoter.
  • The Promoter has the right to change the judging panel at its absolute discretion, including if any unforeseeable circumstances arise. The Promoter will appoint a new judge in the circumstance that any judge is connected with a team or individual.
  • The rankings from each round do not count towards in subsequent rounds.
  • The judges' decision is final and no correspondence will be entered into regarding this decision.
  • Teams may be interviewed by L'OréalProfessionnel Education Managers about their technique, application and colours used on the model to verify the sole use of L'OréalProfessionnel Products.

Judging Criteria:

  • Points will be awarded as follows:
    • 70% Hair; Broken down by
      • 50%: Colour Placement execution, technique and colour choice
      • 20%: Finished result of hair styling / cut if featured
    • 20% Complete Look, Styling of photograph and Luxury Consumer Magazine potential
    • 10% how closely you have re-created your photographic entry
  • The competitors must demonstrate the following:

  • All award winners will be announced at the L'Oréal Colour Trophy Grand Finale on the evening of Monday 25/02/19.

2019 L'Oréal Professionnel Rising Star Award:

Prize estimated value is AUD$70,000 and includes:

  • Trip & admission to an International L'Oréal event (exact inclusions in trip determined by the Promoter). The exact person/s who can travel will be determined by the Promoter.
  • 1 full page editorial in Hair Trends Magazine, to be tipped on to a luxury fashion consumer magazine
  • Support the Colour Trophy winner on the editorial photo shoot for The Journal Magazine.
  • A marketing kit for the entrant's salon.
  • One year subscription to a luxury fashion consumer magazine.

General Prize Conditions:

No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified by the Promoter.
All travellers are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. All travellers apart of the same team must depart from and return to the same departure point and travel together. Frequent flyer points will not be awarded and do not form part of a prize. Travel itinerary will be determined by the Promoter in its absolute discretion.
Spending money, meals, taxes (excluding airline and airport taxes), travel insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs, unless otherwise specified in the prize description specified herein, are not included and are the responsibility of the winner. Travellers may be required to present their credit card at check in.
Prizes are subject to the standard terms and conditions of individual prize and service providers. Subject to the terms and conditions of the participating prize provider(s), if for any reason the winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

To whom prize/s are awarded:

Prizes are awarded to the salon or private hairdressing college rather than individuals within a team and if any members of the winning team leave their salon or private hairdressing college they forfeit their prize experiences and prizes.
Exact method and to whom cash prizes will be awarded will be determined by the Promoter in its absolute discretion.

1. The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.

2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

3. Valid and eligible entries will be accepted during the Promotional Period.

4. Employees (and the immediate family members) of agencies/companies directly associated with the conduct of the Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.

6. The winners will be determined by skill. Chance plays no part in determining the winners. The judges' decision is final and binding and no correspondence will be entered into.

7. All reasonable attempts will be made to contact each winner.

8. No part of this prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified by the Promoter.

9. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, they forfeit the prize and the Promoter is not obliged to substitute the prize.

10. The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.

11. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification.

12. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

13. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may collect entrants' personal information (including through its contractors or agents) or disclose entrants' personal information to its contractors and agents to assist in conducting this competition or communicating with, or developing its relationship with, entrants including to overseas locations such as New Zealand, the USA, Canada, Singapore and other countries in Asia and the EU. By entering this promotion, entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future competition and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this promotion, entrants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the address stated in the Promoter section of these conditions. The Promoter's Privacy Policy, located at www.loreal.com.au/_en/_au/tools/privacy/privacy_1.aspx, contains information about: (a) how entrants can seek access to the personal information the Promoter holds about them and seek the correction of such information; and (b) how entrants can complain about a privacy breach and how the Promoter will deal with such a complaint.

14. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of a prize, if the Promoter determines in their absolute discretion, that a winner is not in the physical or mental condition necessary to be able to safely participate in or accept the prize. It is a condition of accepting the prize that a winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.

15. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.

16. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

17. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify suspend the Promotion and invalidate any affected entries, or suspend or modify a prize.

18. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.

19. All material submitted on entry (e.g. photo(s), image(s), drawing(s), comment(s), sound/video recording(s) and answer(s) to a promotional question) must NOT: (a) be in breach of any laws, regulations and rights, e.g. any laws regarding intellectual property (copyright, trademarks, etc), defamation and privacy; (b) be defamatory, obscene, derogatory, pornographic, sexually inappropriate, contain nudity, aggressive, violent, abusive, harassing, threatening, objectionable or discriminate/vilify any section of the community with respect to race, ethnicity, nationality, religion, origin, sexual preference, mental illness, disability or gender or unsuitable for publication; or (c) contain viruses. Entrants warrant that they own or have the right to license the copyright in any entry submitted by them into this Promotion, for the purposes of this Promotion, that no rights have been granted to any third party in respect of any such entry which would prevent the entry being used as contemplated by this Promotion, and that the use by the Promoter of any such entry will not breach any laws or infringe the rights of any person (including without limitation with respect to privacy, intellectual property and defamation). Entrants must obtain prior consent from any person or from the owner(s) of any property that appears in their entry. By entering, all entrants license and grant the Promoter, its affiliates and sub-licensees an exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (including any portion of their entry) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants further agree, upon request by the Promoter, to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter and to sign any legal documentation to confirm such assignment. Entrants agree that their entry is their original work and does not infringe the rights of third parties, or that they have obtained full prior consent from any person who has jointly created or has any rights in the aforementioned material. Entrants consent to any use of their entry that may otherwise infringe their moral rights. Entrants are responsible for all entries they submit on entry. The Promoter will not be liable for any entries, to the extent permitted by law. The Promoter reserves the right to remove, request removal or decline to publish any entry or portion of an entry for any reason whatsoever, including if in breach of these Terms and Conditions. The Promoter will have no liability to entrants if it exercises this right and entrants must comply with any request made by the Promoter pursuant to this paragraph. The entrant warrants and represents that any material sent or provided by the entrant to the Promoter will not infringe any copyright, trademarks or other intellectual property rights of any third party (including moral rights) and that the entrant has all rights to use the materials and has obtained all necessary consents to comply with any relevant privacy and/or confidentiality requirements. Entrants agree to indemnify the Promoter for any breach of the Terms and Conditions including this clause.

20. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.

21. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

22. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

23. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

24. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
